Annual Service Plan Terms & Conditions
Effective Date: 7/25/2026 These Annual Service Plan Terms & Conditions ("Terms") govern the purchase and use of all annual service plans offered by Legacy Land & Food LLC ("Legacy Land & Food," "Company," "we," "our," or "us"). By purchasing or using a service plan, the customer ("Customer," "you," or "your") agrees to these Terms. 1. Service Plans Legacy Land & Food offers the following annual service plans: •Free •Basic •Advanced •Professional •Stewardship •Legacy Each successive plan includes the benefits, services, and privileges available under the preceding service tiers, unless otherwise stated by the Company. The Company reserves the right to modify, add, or remove services, features, benefits, pricing, or eligibility requirements at any time. 2. Membership Term Each service plan is valid for one (1) year from the date of purchase or activation unless otherwise specified in writing. The Free plan remains active until terminated by either the Customer or the Company. 3. Service Credits Paid service plans include an annual allocation of service credits. Service credits may be redeemed only for eligible services included within the Customer's current service plan. Service credits: •Have no cash value. •Are non-transferable. •May not be redeemed for cash or refunds. •May not be sold or exchanged. •Expire at the end of the applicable annual service period. Unused service credits do not roll over into a subsequent membership term. As part of Legacy Land & Food's commitment to community stewardship, any unused service credits remaining at the end of the membership term will be converted into an equivalent allocation of Company volunteer service hours and donated to charitable or community organizations selected by the Company. Customers are not entitled to designate the recipient organization or receive any tax deduction, credit, or ownership interest arising from such donation. 4. Purchasing Additional Services Customers may purchase additional eligible services beyond their included service credits at the Company's then-current rates. The purchase of additional services does not modify the number of annual service credits included in a service plan. 5. Service Plan Upgrades Customers may upgrade to a higher-tier service plan at any time by paying the difference between the current plan price and the new plan price. Upon upgrade: •The new service plan becomes effective immediately. •The annual membership period restarts from the upgrade date. •A new allocation of service credits associated with the upgraded plan is issued. •Any unused credits from the previous plan are forfeited and will be treated under Section 3 of these Terms. Downgrades during an active membership period are not permitted unless expressly approved by the Company. 6. Fees, Pricing, and Credit Valuation All membership fees are due at the time of purchase. Membership fees are non-refundable except where required by applicable law. Legacy Land & Food reserves the right to: •Modify service pricing; •Change the number or value of service credits associated with any plan; •Adjust the credit cost of individual services; •Introduce, modify, or discontinue service plans. Any pricing or credit changes apply prospectively and do not entitle existing Customers to refunds or retroactive adjustments unless required by law. 7. Geographic Availability Certain services require on-site visits. On-site services are currently available only within the following Oregon counties: •Lane County •Linn County •Benton County Customers located outside these service areas may still purchase plans but may be limited to remote or virtual services unless otherwise agreed in writing. The Company may expand or reduce its service territory at its sole discretion. 8. Scheduling and Service Availability Service appointments are subject to staff availability, weather conditions, travel constraints, safety considerations, and other operational factors. Legacy Land & Food reserves the right to: •Reschedule appointments; •Cancel appointments; •Modify service timelines; •Decline to perform services when circumstances reasonably require. The Company will make reasonable efforts to notify Customers of any scheduling changes. 9. Right to Refuse or Terminate Service Legacy Land & Food reserves the right, to the fullest extent permitted by law, to refuse, suspend, or terminate service or membership at its discretion, including but not limited to situations involving: •Unsafe working conditions; •Harassment, threats, or abusive conduct; •Fraudulent or deceptive activity; •Failure to comply with these Terms; •Illegal activity; •Any other lawful business reason. Termination for these reasons does not entitle the Customer to a refund. 10. Customer Responsibilities Customers agree to: •Provide accurate information when scheduling services. •Provide safe and lawful access to any service location. •Obtain any required permissions or approvals necessary for requested services. •Cooperate with Company personnel during scheduled appointments. The Company is not responsible for delays or additional costs resulting from inaccurate information or restricted site access. 11. No Guarantee of Results Technical recommendations, consultations, and services are based on professional judgment, available information, and conditions existing at the time services are performed. Legacy Land & Food does not guarantee specific environmental, agricultural, financial, regulatory, permitting, landscaping, conservation, or business outcomes unless expressly stated in a separate written agreement. 12. Limitation of Liability To the maximum extent permitted by law, Legacy Land & Food LLC shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from participation in any service plan or the use of Company services. The Company's total liability for any claim arising under these Terms shall not exceed the amount paid by the Customer for the applicable annual service plan during the twelve (12) months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law. 13. Changes to These Terms Legacy Land & Food may revise these Terms at any time. Updated Terms become effective upon publication on the Company's website or other reasonable notice to Customers. Continued participation in a service plan following notice of revised Terms constitutes acceptance of those revisions. 14. Governing Law These Terms shall be governed by and interpreted in accordance with the laws of the State of Oregon, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located within Oregon, unless otherwise required by applicable law. 15. Entire Agreement These Terms constitute the entire agreement between the Customer and Legacy Land & Food LLC regarding annual service plans and supersede all prior discussions, advertisements, representations, or understandings relating to those plans. ______________________________________ Legacy Land & Food LLC reserves all rights not expressly granted herein.
